CloudFran VoicePersuader Product Addendum (Voice, Calls, Recording, AI Voice)
This Addendum supplements the CloudFran Terms of Service and is incorporated by reference into the Master Services Agreement. The Unified Payments + Marketplace Addendum also applies to payment-related features.
1. Scope
This Addendum governs the use of CloudFran VoicePersuader, including outbound and inbound voice calls, AI-generated voice interactions, call recording, and communication workflows.
2. Consent to Call
Users are responsible for obtaining all required consent prior to initiating voice communications, including compliance with TCPA and applicable telemarketing laws.
3. Call Recording Laws
Users must comply with all applicable call recording laws, including one-party and all-party consent jurisdictions. CloudFran does not guarantee compliance and provides tools only.
4. AI Voice Disclosure
Users must disclose when calls involve AI-generated or automated voice interactions where required by law.
5. Do Not Call (DNC) Compliance
Users must comply with national, state, and internal Do Not Call lists and maintain suppression lists where applicable.
6. Fees
Transactions or interactions tied to VoicePersuader workflows may include CloudFran platform fees (3.5% + $0.75 where applicable). Fees are non-refundable.
7. Chargebacks and Disputes
CloudFran mirrors payment processor protections, including $15 dispute fees where applicable. Users are responsible for associated losses.
8. Messaging and Communication Compliance
Users must comply with TCPA, CAN-SPAM, and other communication laws when using integrated voice, SMS, or email features.
9. Liability
CloudFran is not liable for user communications, including call content, consent violations, or regulatory penalties.
10. Data Usage
Call data, transcripts, and analytics may be processed to improve services, AI models, and performance.
11. Fraud and Abuse
CloudFran may suspend accounts or restrict usage for suspected abuse, spam, or unlawful activity.
12. Governing Law
This Addendum is governed by Delaware law with Georgia enforceability considerations.
13. Compliance
CloudFran aligns with SOC2, telecom, and audit readiness standards.
